I am married and my husband has moved on so to speak. I found out that he was cheating on me and continued to do so after we had left. I am trying to file for a divorce but i have so many questions. My most important question is about the baby after its born. I am 100% sure this child is not my husbands. I want to know if the baby will have its real fathers last name on the birth certificate or my husbands last name. I am trying to get a divorce before the baby is born but if not will the baby be considered a product of my marriage even though it isnt his? I am not looking for child support or anything like that all i want is a divorce so i can move on with me life as it seems my husband has. He hasnt called or havent seen him since he left

i havent found anything out if you find anything out also let me know and i will do the same so far everyone has said give the name of the real father on the birth certificate

Is the real father going to be there when the baby's born? I don't know exactly how things work when naming the baby, but I think you can pretty much give him whatever name you want. I do know, though, that if the real father is there and is going to sign the birth certificate, then you most definitely will be allowed to name the baby after him... If he's not going to be there, I THINK you still have that option, but again I'm not positive.

im gonna phone around moday and ill let u know what i find out i probably wont have my divorce go through before the baby is born we both just dont have 5 grand to fork out

ok i found out i found out so you can give your baby any last name but when u fill out the birth certificate u have to swear before a comishioner ( i think thats what its called) that yes that inst your husbands child im glad i found that out and i hope it helped lol it helped me

In Texas, they will not grant a divorce until after the baby is born. One of the questions at the preliminary hearing will be "Are you pregnant?". Depending on how far along you are, you could choose to answer whichever way would benefit your situation. The baby will be considered a product of the marriage unless the soon-to-be ex disputes paternity. Please check with a family law attorney in your area. Sometimes you can find attorneys who will offer a free 30 minute consultation. Good luck.

If you are certain this baby isn't your husbands then your divorce should go smoothly. Do not put your husbands name on the certificate since the baby isn't his.
