My brothers ex refuses to let their daughter go on vacation with our family this year. Can she do this? They have joint custody if that's worth anything! My brother doesn't see his daughter unless my mom gets her and takes her to him because everytime he tried to get her his ex would make problems so he just decided that he wasn't going to put himself in that situation anymore. My mom must jump through hoops too in order to see her grandchild which just shows how immature the childs mother is.But anyway all we want is 2 weeks with her for a vacation, and her mom says ,"NO!" So can joint custody change the rules on her calling the shots or does joint custody mean nothing basically? Why doesn't she see she is hurting her daughter by not letting her go with us? I think she hates us more than she loves her daughter!

it only means something if you go out of state. if your staying in state, than you only need one parents consent. if it is 50 50 custody, you can do whatever you want if its your brothers day/s. im not sure what your custody plan is, but if it goes onto her time,[ lets say that your brother only get the kids for a week, then they switch off, if the vacation is more than a week, its against the law, unless your brothers ex says its ok. if not she can call the police] so basically, if it is your brothers custody day when you go on vacation, as long as it isnt out of the state, then he can take the kids wherever he wants, as they are in his care legally. if it isnt his turn to have the kids, then its illegal. if you go out of state with out BOTH parents permission, its illegal. maybe you should ask the kids what they want, and they can tell thier mother that they want to go, and maybe she will change her mind if the bug her enough. whatever your brother has worked out in court, they must follow, its the law. i hope everything works out for you all.
