My husband pays child support and spousal support. He made payments directly to his ex monthly until the divorce was final (this is what his attorney told him to do.) He is current and never been late on a payment. Now, many months later, CSEA has sent a letter stating that my husband owes past due support . He asked for a hearing and went with all of the cancelled checks and other papaerwork. CSEA says there is proof that he did pay the support beut is in default because he was supposed to pay CSEA directly. His Attorney did not tell him this so he had no idea. as a matter of fact, he gave his attorney a check one month for child support and the attorney gave it to his ex wife's attorney . They ordered him to pay the past due amount of almost $3000.00. He has requested another hearing before the Judge but, the appointment is not until the end of October. My question is, should he hire another lawyer or take his chances and go to the hearing with his paperwork and explain to the judge what is going on? I don't understand why this is happening. Sometimes I can see whey some people don't even try to pay support. It is like fighting a losing battle. (Don't get me wrong, I do believe that men and women should support their children.) I have seen my husband (who loves his children and pays support) treated like he was a criminal because he wants to do the right thing. I would appreciate any advice. ↓
