Good evening girls, I went to work today and they took me straight into the office to tell me that since I brought a doctors note stating I cannot lift, pull, push more than 25lbs, that I can no longer work there due to Delta Air LInes not having such a thing as light duties....
They dont give a fuck about my pregnancy complications.
They said if I cannot come back with full duties to NOT return at all. I am so upset right now. My doctor had said to me since the beginning of my pregnancy that due to my complications I will not be permited to lift anything above that limit. So therefore I am now home.. HELP!!! I am so upset. This will mean no income coming in from my part.
But I am not about to risk the life of my unborn child. ↓

call a lawyer. I am not sure what the laws in your state are, but in many places if they do not have light duty then they have to pay you to stay home. Is there a union? If so call you rep ASAP ↑ |
lots of place are "at will employment" meaning that they can let you go at any time for any reason, but there are still limits. ↑ |
yeh florida is the right to work state, they can let you go with no reason for all they care lol .. but they can not fire due to race, religion, sex, and so on so forth, i would think pregnancy would be included. i would still call ur lawyer and see if you can be put on leave b.c alot of places have to HOLD your job for you at leave until you come back from being pregnant and it doesnt have to be at a certain week. i was just reading baout it last week. ↑ |

OMG, I can't believe employers would do that! I went through taht with my surro preg. After having been working, Labour working in a factory for two years straight--right til I delivered and returned early from Mat. leave EARLY both times--they told me that becuase I was high risk and tow other woman who were no long before were preg. and on light duty--that there was no more light duty work left. I was PISSED. I tried to fight it but their lawyers were better than mine...of course...

You should check your employee handbook, it may have something stated in there and when you filled out new employee paperwork you may have signed something without knowing it. Also check with the FMLA act there may be something in there to protect or compensate you. And check to see if you're a "right to work" state. Even if you are a right to work state, you may still be entitled to unemployment benefits, so also contact your unemployment office. ↑ |

Hmmm I dont think you can do anything about that one...because they can state if they let you work and you hurt yourself or the baby, they could be liable if they let you keep working. Its basically not the right thing to do for health and safety.....

Please dont bite my head off! but here in australia, doing that is perfectly legal...if they dont have a posistion for you that follows the guildlines of the medical certificate.....what are they susposed to do? pay you to sit on a chair..
They should of offered you some sort of termination pay..or a job to return to once you had the baby. But you cant expect a employer to keep paying you for a job you arnt doing.

no i use to work at the airport...there in fact was pg women at united, american, and DELTA [comair]. it is in fact discrimiation and I would take it to a lawyer and fight it!!! let me know what HR says! ↑ |
I would file a claim with the eeoc. You can find the instructions on the web. Something similar happened to me. I was hired at 3 months preg. and they didn't know it. I had a 90 day review period and on the 89th day I was hired with no reason and no previous documentation. I am currently 32 weeks and out of income and medical benefits. I am married and also have a 3 yr old son. It has been a really hard month. I can't beleive in year 2007 this stuff still exists. I feel like we are living in a third world country or the 1920's. Hi. It CAN be seen as discrimination. However, if your work involves solely duties which you doctor has recommended you not to do, then your boss has a point in relieving you of those duties until your doctor says different. Your work cannot fire you, however. ↑ |
I think they have to try to find you something else to do if you are en employee in good standing before letting you go. most states are at will but many have parameters about pregnancy, illness. i'd call a lawyer to find out. ↑ |
